Eviction & Lease Notices

Demand for Compliance/PossessionDemand for Compliance or Possession can be used after the Landlord has served the tenant with a Notice to Quit, Notice to Pay, or Notice of Lease Violation, but the Tenant has not complied. Eviction NoticeThe Eviction & Lease Notices include all the basic notices that both landlords and tenants may need to provide each other during the tenancy and to end the Lease. Our Notices for landlords include Eviction Notice, Notice to Pay, Notice to Quit, Notice of Lease Violation, Notice of Termination, Demand for Compliance or Possession, and Notice to Increase Rent. Our Notices for tenants include Notice to Repair, Notice of Intent to Vacate, and Notice of Termination for various reasons. You also have the option to have a Proof of Service created with your notice. Notice of Lease ViolationA Notice of Lease Violation is used where a Tenant has failed to comply with the Landlord's rules or breached a term of the Lease. The Landlord is giving the Tenant notice to remedy the violation within the notice period. The Landlord may choose to terminate the Lease if the violation is not remedied OR to remedy the violation itself at the Tenant's expense. Notice of TerminationNotice of Termination is used when:
  1. The Landlord wishes to terminate a periodic tenancy (such as a month to month lease), or
  2. The Lease Agreement requires advance notice for the termination of the Lease.
 Notice to QuitNotice to Quit is used by the Landlord to terminate a lease when the Tenant has:
  1. Failed to pay rent within the required time after it was due.
  2. Caused serious damage to the premises.
  3. Acted violent or made threats to the health and safety of other Tenants and/or the property.
  4. Performed illegal activities, such as prostitution or drug use, on the Premises.
 Notice to RepairNotice to Repair is used when the Tenant wants to give notice to the Landlord that the Landlord is breaching a term of the Lease or the state legislation by not properly maintaining the Premises. Rent Increase NoticeA Notice of Rent Increase is used where a Landlord wishes to increase the rent charged on a Premises.

Real Estate Transaction Forms

Contract for DeedA Land Contract (or Contract for Deed) is a contract between a seller and buyer of real property, where the seller provides the financing. Deed of ReconveyanceA Deed of Reconveyance is a document from a Beneficiary (lender), that releases a Trustor (borrower) from a debt once it has been paid in full. It is used when the original debt was secured by a Deed of Trust. Deed of TrustA Deed of Trust is a document that allows a borrower to transfer the legal title of its property to a trustee who holds the property in trust as security for the payment of the debt to the lender. If the borrower pays the debt as agreed, the deed of trust becomes void and the lender executes a Deed of Reconveyance. If, however, the borrower defaults, the trustee may sell the property at a public sale under the terms of the deed of trust. Land ContractA Land Contract (or Contract for Deed) is a contract between a seller and buyer of real property, where the seller provides the financing. Mortgage AgreementA Mortgage Agreement is a document used by a mortgagee (lender) to secure a loan in the mortgagor's (borrower’s) purchase of real estate. Quitclaim DeedA Quitclaim Deed is used to transfer whatever interest or title a grantor may have in property, without providing a warranty as to full title in the property. Quitclaim Deeds are frequently used in transfers of property between people well-known to each other, such as family members or divorcing spouses. Real Estate Purchase AgreementA Real Estate Purchase Agreement is a sales agreement for completed homes. LawDepot’s Real Estate Sale Agreement deals with new houses (construction completed). It contains additional disclosure forms, if required. Satisfaction of Mortgage AgreementA Satisfaction of Mortgage is used when the original debt was secured by a mortgage. It is a document used by the Mortgagee (lender) to acknowledge that the debt of the Mortgagor (borrower) has been paid in full. Upon the filing of the satisfaction of mortgage, the Mortgagee's lien should be cleared from the title deed. Survivorship DeedOur Survivorship Deed is a special deed where two or more individuals own property with a right of survivorship. On the death of one of the owners, the property goes to the surviving owners. Warranty DeedA Warranty Deed is one in which the grantor fully warrants good clear title to the property, free from any encumbrances that are not listed on the deed. It is used in most real estate deed transfers, as it provides the greatest protection of any deed.
