What are a residential landlord's responsibilities?

Renting a property does not come without tasks and responsibilities. As a landlord, you can be proactive and stay ahead of the game. Still, unforeseen events that require your involvement are sure to happen.

In addition to always obeying your province's or territory's laws and complying with the terms of a tenant's lease, landlords must fulfill the following responsibilities:

1. Ensure your rental property is safe and habitable

It is vital that you provide safe and habitable housing to your tenants, both at the beginning and throughout their tenancy. Providing habitable housing includes:

  • Ensuring the property's entrances have working locks
  • Ensuring the property is structurally sound
  • Maintaining the electrical, plumbing, and heating systems
  • Removing hazards from the property
  • Taking steps to prevent pest infestations

An integral part of providing safe and habitable housing is meeting local, provincial or territorial, and national housing codes, such as the National Building Code of Canada 2015. In most of Canada, landlords must comply with the Personal Information Protection and Electronic Documents Act (PIPEDA). PIPEDA outlines the rules for how businesses, including landlords, must handle others' personal information. According to PIPEDA, you must:

  • Obtain your tenant's consent when you collect, use or disclose their personal information
  • Identify the reasons for collecting personal information before or at the time of collection
  • Provide your tenant with access to the personal information that you hold about them and allow them to challenge its accuracy
  • Only use a tenant's personal information for the intended purposes
  • Protect a tenant's personal information with appropriate safeguards

In British Columbia, Alberta and Quebec, there are provincial private sector laws that may apply to landlords instead of PIPEDA.

5. Pay taxes on your rental income

In Canada, there are tax implications for renting out real estate property. If you received income from renting out a property, you must file a statement of income and expenses.

To create a statement of income and expenses, the Government of Canada encourages landlords to use Form T776. This form allows you to enter and calculate your rental income, expenses, and any capital cost allowance (CCA) that applies.

Across Canada, tenants have many rights that limit the actions their landlords can take. Generally, as a landlord, you cannot:

  • Prevent your tenant from entering the rental property
  • Enter the rental property without adequate notice

  • Misrepresent the true condition of your rental property when advertising it
  • Ask invasive or unnecessary questions
