Who must sign this Codicil?A Codicil must be signed by the Testator “in the presence of” at least two other people, each of whom must sign the Codicil “in the presence of” the Testator. Signing “in the presence of” another means the parties actually watch each other sign the Codicil.
The Testator and the witnesses should also initial the bottom right hand corner of each page of the Codicil (except the last page which is signed by everyone).
Witnesses should NOT be individuals who will be receiving gifts in the Testator’s Codicil or Last Will, or the spouses of individuals who will be receiving gifts in the Testator’s Codicil or Last Will.
